Disqualification from driving for violation of the rules on driving time and break periods

The accused, a lorry driver, was found guilty of violation of the rules on break periods in Regulation (EC) No. 561/2006 of 15 March 2006 on driving time and rest periods. The second break taken by the accused lasted 18 minutes and did not meet the requirements set up in the Regulation on breaks. Consequently, both the rules on driving time and the rules on break periods had been violated by more than 30%, which led the Supreme Court to the conclusion that T should be disqualified from driving, which was in line with the decision passed by the District Court.
