ROJ TV – Disqualification

The company ROJ TV A/S, which had been found guilty of promoting terrorism, was disqualified from broadcasting television

The High Court had found the company ROJ TV A/S guilty of promoting terrorism by PKK through television programmes during a period of over four years.

The case before the Supreme Court concerned whether ROJ TV A/S could be disqualified from broadcasting television as it was licensed with the Danish Radio and Television Board.

The majority of the Supreme Court held that the provisions in the Danish Penal Code on disqualification also apply to legal persons (companies etc.), and that there was basis in this case for disqualifying ROJ TV A/S from broadcasting television.

The High Court had reached the same conclusion.
